General terms of use

These General Terms of Use apply to the use of the M-Login. The M-Login is the portal of Stadtwerke München GmbH ("SWM"), through which registered customers can centrally manage their user data. The data stored in the M-Login can be activated by the customer for selected services ("Service" or "Service Offerings") of SWM, certain affiliated companies, or other third parties ("Providers"), allowing the customer to access and use these services. The purpose of the M-Login is to enable customers to have a clear and centralized user profile management as well as a secure and centralized login for the use of services.
1. Scope and Content of Services
1.1 Profile Data Management
The M-Login of SWM allows customers to centrally manage their user profile data. Customers can store and manage their profile data in the M-Login.
1.2 Authentication
The M-Login of SWM enables customers to digitally access various selected services. Customers can log in and use the closed personal area of the respective services using the login credentials recorded during M-Login registration (mandatory details: username (email address) and password). Details regarding the use of the services can be found in the terms and conditions of the respective provider.
1.3 Storage of Payment Methods
Customers have the option to store and manage payment methods in the M-Login to pay for the services they use. The prerequisite is that the stored payment method is also accepted by the relevant provider. Payment data is stored, where permitted, by SWM and otherwise by payment service providers contracted by SWM. These payment service providers handle payments on behalf of SWM.
Customers may store the following payment methods:
- Billing via SEPA direct debit
- Billing via credit card (Visa, MasterCard, or American Express)
Other payment methods are excluded. There is no entitlement for users to use a specific payment method among those mentioned. Details regarding payment conditions for individual services can be found in the respective terms of the relevant service provider.
1.4 Adding a Portrait Photo
Customers can upload a portrait photo. If a service requires the provision of a portrait photo for the use of its services (e.g., for issuing personalized tickets to prevent misuse), this photo can be made available to the provider via the M-Login. It is prohibited to upload images of third parties or images that infringe upon the rights of third parties, are unsuitable for identifying the customer, or contain obscene, offensive, discriminatory, or otherwise harmful content. Details about the use of the service are determined by the terms and conditions of the respective provider.
1.5 Adding a Family Member
Customers can add a family member to their M-Login account. If a person under the age of 18 is added, the consent of the legal guardian (e.g., parents) is required. Adding an adult as a family member requires their consent. If a provider allows services to be used by both the customer and/or a family member within an offering, the necessary data can be provided through M-Login. Details regarding the use of the service are determined by the respective terms of the relevant provider.
1.6 Validation of Student Status
The M-Login of SWM enables customers to access service offerings exclusively intended for students. Details are determined by the offering of the respective provider. In such cases, the customer can only use the provider's service if they digitally prove their student status. Proof of student status can be conducted via a digital verification through the customer's university or college. However, digital verification is only possible if the respective university or college participates in the verification process provided by SWM.
1.7 Verification of a Driver's License and/or an Official Identification Document
In some cases, the use of a service requires prior verification of a driver's license and/or an official identification document to prove a valid driving license or the customer's identity. The verification is conducted by a third party commissioned by SWM, which provides the verification result and relevant data to SWM for storage. The terms and conditions of the third party apply, provided they are validly included for the customer. Additionally, the terms and conditions of the provider apply to the use of the service. Customers are not entitled to verification.
1.8 Data Sharing and Data Provision
The services under clauses 1.1 to 1.7 can be used by the provider of a service if the customer consents to data sharing for the respective service in M-Login. By granting consent, the customer authorizes SWM to provide the respective service provider with the data stored in M-Login for the purpose of delivering the service. Subsequent changes to the data stored in M-Login will also be made available for retrieval by the provider. SWM is not obligated to transmit data. The retrieval of the provided data is performed by the respective provider.
1.9 Contractual Partner
The contractual partner of the customer for the provision of services is Stadtwerke München GmbH, Emmy-Noether-Straße 2, 80992 Munich.
2. Services of Providers
2.1 Additional Agreements
If the customer uses services provided through M-Login, they enter into additional (potentially chargeable) agreements with the service provider for the use of these services. These agreements are not subject to these terms of use.
2.2 Individual Terms
Separate terms of use apply to the use of a service. Customers can find the scope and exact content of the services in the respective terms of the relevant service or provider.
3. Registration and User Account
3.1 Registration Requirements
To use M-Login, a user account is required. This involves registering at https://login.muenchen.de by providing mandatory details (a valid email address as the username and creating a password). Additionally, the customer must agree to these terms of use. By submitting the mandatory details, the customer offers SWM a contract for the use of a user account based on these terms. The customer will then receive a confirmation email containing a verification link, which must be confirmed within a specified time. The contract comes into effect upon successful verification. If registration fails, the data provided will be deleted.
3.2 One-Time Registration
Each user may only register once with their email address. The user account and login credentials are non-transferable.
3.3 Contract Language
The language of the contract is German.
4. Customer's Obligations
4.1 Accurate Information
The customer is obligated to provide complete and accurate data, including a valid email address and payment details. The information must be kept up to date for the duration of the contract. Nicknames or fictitious names are not permitted.
4.2 Password Confidentiality
The password for M-Login must be kept confidential. Sharing the password with third parties is prohibited. In case of loss or suspected unauthorized access, the customer must immediately inform SWM and change the password. The SWM reserves the right in accordance with Section 5.
5. Blocking of Access
5.1 Temporary Blocking
If there are indications that the customer has violated these Terms of Use or applicable laws, SWM reserves the right to temporarily block the customer's access to M-Login until the matter has been clarified, unless the customer can prove that they are not responsible for the violation. Once the reason for the blocking no longer applies, access will be reactivated.
5.2 Permanent Blocking
In the case of repeated violations of these Terms of Use or applicable laws, despite prior warnings from SWM to cease such violations, SWM is entitled to permanently block the customer’s access. Restoration of access rights is then excluded. SWM will notify the customer in text form (e.g., via email) before permanently blocking access, unless the customer has provided an invalid email address. In such cases, the permanent blocking will occur without prior notice. Additionally, by permanently blocking access, SWM simultaneously terminates the usage contract as specified in Section 10.3.
5.3 Immediate Permanent Blocking
In justified cases, SWM is entitled to permanently block access without prior warning. A justified case arises in particular if the customer:
a) Provides false, incomplete, or outdated information during registration or use of M-Login, thereby impairing or disrupting the contractual relationship (e.g., by providing an invalid or short-lived email address).
b) Misuses M-Login or related services, for example, by providing false information about a driving license, student status, or other authorizations.
c) Shares login credentials (even unintentionally) with third parties.
5.4 Re-registration
Re-registration is not permitted if a customer's access has already been permanently blocked by SWM, except in cases of unintentional sharing of access credentials under Section 5.3(c).
6. Customer's Right of Withdrawal
6.1 Withdrawal Right
If the customer qualifies as a consumer under Section 13 of the German Civil Code (BGB), they are entitled to a statutory right of withdrawal.
6.2 Withdrawal Policy
Right of Withdrawal
The customer has the right to withdraw from this contract within 14 days without providing any reason.
The withdrawal period is 14 days from the date the contract was concluded.
To exercise the right of withdrawal, the customer must notify SWM (Stadtwerke München GmbH, Emmy-Noether-Straße 2, 80992 Munich) via a clear statement (e.g., a letter sent by post or an email to kontakt@login.muenchen.de) of their decision to withdraw from the contract.
To meet the withdrawal deadline, it is sufficient for the customer to send the notification regarding the exercise of the withdrawal right before the withdrawal period expires.
Consequences of Withdrawal
If the customer withdraws from this contract, SWM will reimburse all payments received from the customer without undue delay and no later than 14 days from the day SWM receives the withdrawal notice.

Expiry of the Withdrawal Right
The right of withdrawal expires for contracts concerning the provision of services once the service has been fully performed, provided that the performance began with the customer’s prior express consent and acknowledgment that they would lose the withdrawal right once the contract is fully performed.
7. Fees
The registration and use of the M-Login are free of charge for the customer.
8. Availability
There is no entitlement to uninterrupted use of the M-Login, which is provided free of charge. SWM does not guarantee that the use of M-Login will not be interrupted or impaired due to maintenance, further development, or other disruptions (e.g., hardware and software errors or technical issues during data transmission). These interruptions may lead to data loss. However, SWM will make every effort to ensure the usability of M-Login without interruptions wherever possible.
9. Liability
9.1 General Liability
SWM shall be liable to customers in all cases of contractual and non-contractual liability in accordance with statutory provisions in cases of intent and gross negligence.
9.2 Limitation of Liability
In all other cases, SWM shall only be liable for the breach of a contractual obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer may regularly rely (cardinal obligations). In such cases, liability is limited to the typical, foreseeable damage. In all other cases, SWM’s liability is excluded unless otherwise provided in Section 9.3.
9.3 Exceptions
The liability exclusions and limitations under Sections 9.1 and 9.2 do not apply to claims arising from injury to life, body, or health or under the German Product Liability Act.
10. Contract Duration and Termination
10.1 Contract Duration
The contract begins with the activation of the user account and ends upon termination by either SWM or the customer.
10.2 Termination by Either Party
Both parties may terminate the contract at any time without notice.
10.3 Termination Procedure
Termination must be communicated in text form (e.g., via email). Customers may also terminate the contract by requesting the deletion of their user account or by using a deletion link provided by SWM.
10.4 Consequences of Termination
Upon termination:
a) The M-Login will no longer be accessible to the customer, and all rights granted under the contract will expire.
b) Access to services and offerings via M-Login will end.
c) SWM may irreversibly delete any data stored in the M-Login after 30 calendar days, provided all legal retention periods have expired. Customers may request the export of their data in a structured, machine-readable format during this period, although no entitlement to this exists.
10.5 Extraordinary Termination
The right to extraordinary termination remains unaffected.
11. Deletion of Data
11.1 Deletion After Termination
In the event of termination, all customer data and associated content stored during the use of the service will be irreversibly deleted within 30 days, unless legal retention obligations apply.
11.2 Deletion Following Permanent Blocking
If the user account is permanently blocked due to a breach of these Terms, SWM reserves the right to delete the customer’s data within 30 days. Exceptions apply where legal obligations or justified interests (e.g., evidence preservation) require longer retention.
12. Changes to the Contract
12.1 Amendments to Terms
SWM may amend these Terms of Use at any time, subject to providing reasonable notice. Customers will be informed of the amendments via email. If the customer does not object within 30 days, the changes will be deemed accepted. In case of objection, SWM may terminate the contract. Customers will be informed of the significance of the objection period in the email notification.
12.2 Changes to Services
SWM reserves the right to modify the scope of the M-Login, introduce new features, or discontinue existing ones, taking into account the legitimate interests of the customer.
13. Complaints and Dispute Resolution
SWM is not obligated to participate in dispute resolution proceedings before a consumer arbitration board and does not take part in such proceedings. 14. Miscellaneous
14.1 Severability Clause
If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.
14.2 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
